Enhanced social protection and clearer responses to recidivism

The Riksdag has voted in favour of the Government's proposal on enhanced societal protection and clearer responses to recidivism.

The aim of the proposal is to strengthen the societal protection in the event of serious and repeated crime, to reduce the risk of recidivism, to increase the security of victims of crime and to intensify reactions in the case of misconduct or recidivism.

The legislative amendments will entail, for example:

  • Escape from certain forms of deprivation of liberty, such as custody, institutions and detentions centres, will be criminalised;
  • Recidivism will be given greater importance in the setting of penalties;
  • The possibilities of reconciling probation with imprisonment will be expanded;
  • A person who is sentenced to probation or is conditionally released will be subject to restrictions on freedom of movement (residence orders) if he or she is involved in or is linked to a group which carries out serious crime and risks committing or otherwise contributing to serious crime in a particular place or area;
  • Residence orders may be issued in order to protect injured parties;
  • It is stipulated by law that involvement in, or connection to, a group that carries out serious crime shall be taken into account in the decision temporary release.

The amendments will come into force on 2 July 2026.
