New legislation to replace the Care of Young Persons Act (LVU)

The Riksdag has voted in favour of the Government’s proposal that the current Act on the Care of Young Persons (Special Provisions) Act (LVU) be replaced by a new act on the taking into care of children and young persons and a new act on special powers for state child and youth care services.
The purpose is to achieve modern, clear and transparent legislation that is based on the child as the bearer of rights and that responds to the needs for protection and support that children and young people have today. The children’s rights perspective is strengthened by, among other things, concentrating the rights of children and young people into their own chapter in law. In addition, the right to public counsel will be clarified and expanded.
A new basis of the taking care of children and young people due to the connection with their family home will also be introduced into the new legislation. It should be possible to make use of this when there are no longer any deficiencies in a child’s home circumstances and care should therefore be terminated. If, in such a situation, there is a significant risk that the child will be harmed by being separated from the family home in which the child has been placed, and it is in the best interests of the child that the care should continue, the new additional basis for continuation as a result of the family connection can be applied.
The new regulations will come into force on 1 January 2027.
